Penalty: Apprentice Jockey Triston Moodley is fined $400

Evidence:

The Applicant, Chief Stipendiary Steward Mr J Oatham, filed an Information pursuant to Rule 346(3) alleging that Apprentice Rider Triston Moodley, failed to make the required weight for SHOES.

The Respondent was present at the hearing and confirmed his admission of the breach. Trainer Mr D Walker was present to assist.

Rule 346(3) provides:

“A Rider shall not fail to ride a horse at the weight at which it is handicapped to carry”. 

Mr Oatham explained that SHOES was carded to carry 55kgs in Race 8 today. At the start of the day, a Stable rep advised the Stewards that Mr Moodley would be struggling to claim his full weight allowance, but requested until Race 4, to see if he could get down to correct weight.

Mr Moodley’s current Apprentice claim is 2kgs, which meant SHOES would carry 53 kgs in the race. It became apparent that Mr Moodley was not going to be able to claim that amount. The closest he could get was 54.8kgs (1.8kgs over). He was replaced by another Apprentice Rider, who could claim correct weight.

Mr Moodley had no comment.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Mr Oatham advised that Mr Moodley had 2 previous breaches under the MIN scheme, which is the reason for today’s breach coming to the Adjudicative Committee for determination. Stewards’ submission was for a monetary penalty in the vicinity of $300 – $400.

Reasons for Penalty:

In circumstances where Stewards elect to file an Information, determination of penalties are fact dependent. The Adjudicative Committee considered all submissions. An aggravating feature for today’s breach is that Mr Moodley had to be replaced as the Rider of SHOES, due to being well over the weight meant to carry. Fortunately, an adequate replacement was available.

Conclusion:

The Respondent is fined $400.
