Penalty: Jockey Triston Moodley is suspended for 6 days

Mr Davidson alleged that in Race 3, Mr Moodley (MAWKEB) rode carelessly in that he shifted ground inwards passing the 200 metres, crowding ACESANJACKS and TAP’N’GO, who were both checked.

Mrs Fisher demonstrated on the videos, that the Respondent was racing in the middle of the track after the field had rounded the home bend. Halfway down the straight, he shifted ground inwards, crowding ACESANJACKS and TAP’N’GO. Mr Muniandy on ACESANJACKS, was checked. She demonstrated on the side-on video, that Mr Moodley was not his length and another clear.

Mr Davidson acknowledged there was some outwards movement from Mr Campbell, which had contributed to the incident. But the principal movement was that from Mr Moodley.

Mr Moodley acknowledged he had shifted in quite a bit in the straight. He said while two Riders had been hampered, there had been no yelling.

Mr Laking agreed with the Stewards, that Mr Moodley had not been clear when he shifted ground and also commented there had been movement from the inside. He added that even without that, there had been tightening.

Decision 

As Mr Moodley has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which evidenced 2 previous breaches of this Rule in the past 12 months. The first breach was in March and the second was in November. One was mid-level and the other low level. He was a busy Apprentice Rider, with 504 rides in the past 12 months. He had a suspension that would end on 22 February.

Mr Davidson described the breach as mid-range, with two runners being affected quite badly.

Mr Moodley confirmed his record and accepted the Stewards’ assessment of the breach.

Reasons for Penalty

The Penalty Guide provides a 7-day starting point for a mid-range breach, which as the parties agree, is an accurate assessment of the gravity of the breach. Both Mr Muniandy and Mr Callaway were hampered and had to take hold of their mounts. There is a one-day discount for record, which is good considering the number of rides Mr Moodley has had this last 12 months and his admission of the breach.

Conclusion

Mr Moodley is suspended from the end of racing on 22 February, up to and including 5 March 2026. This is 6 National Riding Days.
