Outcome: Proved

Penalty: Apprentice Jockey Crystal Lindsay is suspended for 5 National Riding Days

Evidence:

Following the running of Race 7, the “MAHONEY CONTRACTORS” 1200m, and the conclusion of the protest lodged by Mr C Dell, the Rider of BEETLEGEUSE, against Ms Lindsay’s mount, LATER BOY, Mr Goodwin presented an Information charging Ms Lindsay with careless riding in breach of Rule 638(1)(d).

It was alleged that Ms Lindsay allowed her mount LATER BOY to shift ground outwards passing the 200 metre mark, checking BEETLEGEUSE, which had to be steadied and change ground.

Ms Lindsay, assisted by Ms Clapperton, admitted the charge.  It is established on the evidence presented at the protest hearing.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Goodwin advised that Ms Lindsay has made excellent progress since moving to the Central Districts and had no breaches since November 2023 (when at Ashburton).  He expressed the view this breach was in the low range and only as the horse was under pressure and hanging when it moved outwards.

Ms Lindsay did not dispute that, but said she had mounts this week, so a short deferment was sought.

Reasons for Penalty:

The Guide suggests a suspension of 5 days is appropriate.  The fact that a relegation resulted is said to be aggravating, so an increase is on the cards.  But, the Adjudicative Committee must factor into the exercise the obvious mitigating issues, which include the excellent record of a promising young Apprentice.

Conclusion:

Accordingly, the suspension of her Licence is fixed at 5 National Riding Days, to commence at the conclusion of racing on 2 October 2024 and to end at the conclusion of racing on 9 October 2024.
