Outcome: Proved

Penalty: Apprentice Jockey Crystal Lindsay is suspended for 2 weeks

FACTS:

Apprentice Jockey C Lindsay, aided by Racing Mentor K Clapperton, admitted a breach of Rule 636(1)(d) in that she failed to ride her mount TRIATHLON out to the end of the race, allowing horse ZACKERY to finish third. The margin was half a length.

EVIDENCE:

Stipendiary Steward N Goodwin, using the available films, showed the final 100 metres of the race. TRIATHLON was clearly running third until about 3 or 4 strides short of the winning post, when Apprentice Jockey C Lindsay stopped riding and stood up. He stated the margin between 3rd and 4th was half a length.

Apprentice Jockey C Lindsay informed the Adjudicative Committee that it was her first day back riding after about four weeks. Her mount raced fiercely and tired quickly. She added it was very hot. It was, she said, the horse’s second run back after a spell.

Racing Mentor K Clapperton added that she felt the heat of the day contributed to the lapse of judgement by Apprentice Jockey C Lindsay.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS ON PENALTY:

Stipendiary Steward N Goodwin asked for a period of suspension to be imposed, but asked for a reduction from the recommended figure of 3 weeks. He asked for consideration to be given to the fact that it was Apprentice Jockey C Lindsay’s first day back riding and it was very hot for both horse and Rider.

Apprentice Jockey C Lindsay had nothing to add and did not ask for a deferment.

REASONS FOR PENALTY:

In coming to its decision to impose a period of suspension, it was noted that there was a reduction of stake money to the Owners because of the Apprentice Jockey’s actions, but it was felt because of the reasons outlined in the submissions, a reduction in penalty was appropriate in this particular case.

CONCLUSION:

Apprentice Jockey C Lindsay was suspended for a period of two weeks, ending on 20/2/24 and beginning immediately.
