Outcome: Proved

Penalty: Apprentice Jockey Crystal Lindsay was fined $200

FACTS:

Apprentice Jockey Crystal Lindsay confirmed that she admitted a breach of the Rule, that she failed to ride her mount out to the end of the race when there was a reasonable chance of it finishing in 5th position.

EVIDENCE:

Stipendiary Steward A Dooley using the available films, pointed out that her mount was clearly running 5th just short of the winning post, when Apprentice Jockey C Lindsay relaxed her grip on the reins and raised her whip above her head. He estimated that it was a couple of strides short of the line. Jockey Mentor N Harris confirmed the incident and said that it was an error of judgment on her part which could partially be blamed on limited race day experience.

DECISION:

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS:

Stipendiary Steward A Dooley pointed out that this was her first breach of the Rule in 108 rides although she had been spoken to by the Stewards regarding this Rule previously. He asked for a fine to be imposed as per the Guidelines, but asked that because of admittance of the breach and her record, a discount be accorded.

Apprentice Jockey C Lindsay had nothing to add.

REASONS FOR PENALTY:

A fine as per the Guidelines was deemed appropriate, and a discount reflecting her admittance of the breach and her record in the short time she has been race riding, was considered to be warranted.

CONCLUSION:

Apprentice Jockey C Lindsay was fined $200.
