Background:

Following the running of Race 8 the ‘Cavallo Farms & Chris Rutten Bloodstock Handicap’ an Information was lodged alleging a breach of Rule 638(3)(g)(i). Details are as follows:

‘struck his mount ‘Cee Are El’ with the whip seven times prior to the 100 metre mark with a further four strikes inside the 100 metres

Rule 638(3)(g)(i) provides – a Rider must not:

(i) as except provided for in (iii)(A) and (iii)(B) of this sub rule, strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion with the hand remaining on the reins); where

(iii) it shall not be a contravention of (i) of this  sub rule if:

(B) a Rider strikes a horse seven times prior to the 100 metre mark, provided that a Rider does not strike the horse more than 3 times after the 100 metre mark.

The Respondent confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach. The Respondent asked that he be excused from the hearing. This was granted after hearing his submission as to penalty.

Evidence:

Using available film, Stewards identified the incident. The Respondent was seen to strike his mount twice prior to the turn, and on an additional 5 occasions before the 100 metre mark. A further 4 strikes were noted between same and the finish line.

Decision:

As the Respondent admitted the breach , the Adjudicative Committee found the breach proved.

Submissions as to Penalty:

Stewards outlined the Respondent’s record as it relates to any breach of this particular Rule within the last six months. His record is clear. The Adjudicative Committee was referred to the current NZTR Penalty Guide, which provides for a $250 fine in circumstance of a 1st offence, 2 additional strikes.

The Respondent did request that a suspension be considered in lieu of a fine.

Reasons for Penalty:

Film clearly identifies the incident and breach. NZTR Penalty Guide provides for a $250 fine in this circumstance. This was imposed. Suspension of the Rider’s Licence was not deemed appropriate.

Conclusion:

Jockey Madan Singh was fined $250.
