SUMMARY OF FACTS:

Following Race 9, Millenium Hotels & Resorts Rating  65, Jockey Kavish Chowdhoory was charged that, as the Rider of WILD LIKE in the race, he used his whip in an excessive manner prior to the 100 metres.

SUBMISSIONS:

Mr Oatham had Stipendiary Steward, Mr Mark Davidson, show a video replay of the final 400 metres of the race. He pointed out WILD LIKE, ridden by Mr Chowdhoory, racing towards the rear of the field and come wide to improve. Mr Oatham alleged that Mr Chowdhoory had used his whip on a clear seven occasions prior to the 100 metres. Mr Pitman accepted that alleged count.

Mr Chowdhoory said that, although he had used his whip seven times prior to the 100 metres, he only used it once more to the finishing line. Mr Pitman said that the Rule was the most ridiculous Rule in Racing and it was being highlighted by the number of charges being brought. Mr Chowdhoory had broken the Rule but he did not use the whip “excessively”. He had hit the horse three times after turning for home and a further four times from the straight entrance to the 100 metres.

REASON FOR DECISION:

Mr Chowdhoory has admitted the charge and its is found proved accordingly.

SUBMISSION FOR PENALTY:

Mr Oatham said that Mr Chowdhoory has three previous breaches – on 5th April at Riverton ($300 fine for 8 strikes), 24th April at Riccarton ($500 fine for 8 strikes) and 6th May at Riverton (treated as a 4th offence, 5 days for 7 strikes). Today is the 4th breach for which the Guidelines suggest a starting point of a 5-days suspension. Mr Chowdhoory sought a deferment until after the meeting of Oamaru JC on 20th August.

REASON FOR PENALTY:

The Committee noted the starting point for a 4th offence under the Penalty Guidelines of a 5-days suspension. We have taken that starting point. However, we viewed Mr Chowdhoory’s record as a poor one (four breaches in 4 1/2 months) and an obvious aggravating factor, for which an uplift was called.  We set that uplift at two days.

CONCLUSION:

Apprentice Jockey Kavish Chowdhoory is suspended from 21 August to 1 September 2021, both dates inclusive – 7 national riding days
