Mr Davidson alleged that K Chowdhoory permitted his mount FINGERPRINTED, to shift inwards when not sufficiently clear of MADAME GISELLE which was crowded and checked passing the 1000 metres.

Mr Oatham demonstrated on the videos that the Respondent shifted inwards when not his length and another clear of MADAME GISELLE (L Callaway) causing the Rider of that horse to have to check his mount.

Mr Chowdhoory stated that he knew Mr Callaway was there and he thought he was clear when he shifted, but he now recognised that he was not.

Decision as to breach

As Mr Chowdhoory has admitted the breach it is found to be proved.

Submissions as to penalty

Mr Davidson produced the Respondent’s record, which evidenced 2 breaches of this Rule in the past 12 months.  These were in July and September. Mr Davidson said Mr Chowdhoory was a busy Rider, having had 405 rides in that time.  He described the breach as at the low end with Mr Callaway having been “cut short”.

Mr Chowdhoory stated he accepted Mr Davidson’s submissions and asked that the suspension start after racing at Kumara on 6 January.

The Informant did not object to this.

Reasons for penalty

Mr Chowdhoory has shifted ground inwards when not his length and another clear of an inside runner. He was aware the horse was there and has made a misjudgement.

It is a low range breach and from a 5-day starting point there is a one-day reduction for admission and Mr Chowdhoory’s comparatively good record, when regard is had to the number of rides he has had in the past 12 months.

Penalty

Mr Chowdhoory is suspended from the end of racing on Saturday, 6 January up to and including Friday, 12 January 2024. This is 4 national riding days.
