Background

Mr Davidson alleged that in Race 4 Mr Chowdhoory struck his mount ZOULANDER six times prior to the 100 metres.

Mr Davidson demonstrated on the videos that the Respondent was making a run to the outside of the track and struck his mount ZOULANDER six times prior to the 100 metres.  Mr Chowdhoory said he had a made a mistake in that he had not taken into account the first strike, which Mr Davidson described as a tap to the horse’s shoulder.

Decision

As Mr Chowdhoory has admitted the breach, it is found to be proved.

Submissions as to penalty

Mr Davidson produced the Respondent’s record which showed one breach in the previous six months, on 30 October last. Mr Davidson submitted that a penalty in accordance with Guidelines was appropriate.

Mr Chowdhoory accepted this.

Reasons for Penalty

The NZTR Guidelines provide for a fine of $250 where there is one additional strike, and the Jockey has a previous breach in the past six months. There are no aggravating circumstances. As Mr Davidson said, the strikes were reasonably well spread.

Conclusion

Mr Chowdhoory is fined the sum of $250 and is reminded of his obligations under the Whip Rules.
