EVIDENCE:
Following the running of Race 1, Mr Oatham presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Ms Samantha Wynne.
Mr Wynne stated she understood the Rule, the Charge and confirmed she admitted the breach.
Mr Oatham played the final straight video to identify Ms Wynne three wide as the field entered the straight and counted 7 strikes before the 100m. He said Ms Wynne has struck her mount 4 times after the 100m, one too many for it to be considered in relation to the cumulative strike allowance.
Ms Wynne firstly apologised for the breach and then agreed with the count.
DECISION:
The Respondent having admitted the breach, it was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham said Ms Wynne had 4 previous breaches, they are as follows:
9 October, 7 strikes, fined $250.
22 October, 7 strikes, fined $500.
18 November, 6 strikes, fined $500.
2 December, 6 strikes suspended 2 days and fined $500.
Mr Oatham said a suspension in line with the Guidelines is warranted.
Ms Wynne made no submissions for Penalty, but said she had confirmed rides at Kurow on Saturday 30th December.
REASONS FOR PENALTY:
The Penalty Guide provides for a 5th and following breach, a 5+ day suspension for 2 or more additional strikes. The Adjudicative Committee, with consideration of Ms Wynne’s frank admission, concludes a 6-day suspension is appropriate in the circumstances of this case.
CONCLUSION:
Deferment is granted and Jockey Samantha Wynne is suspended from the conclusion of racing on 30 December 2023, up to and including racing on 5 January 2024.
