EVIDENCE:

Following the running of Race 1, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Ms Jasmine Fawcett.

Ms Fawcett stated she was conversant with the Rule, the Charge and confirmed she admitted the breach.

Mr Davidson showed the final straight video to identify Ms Fawcett riding LUSCIOUS LOVER in the centre of the track. He pointed to Ms Fawcett strike her mount 8 times prior to the 100m and said there was a ninth strike, which couldn’t be determined if it was before or after the 100m pole.

Ms Fawcett said although she was aware of the change in the Rule, she had misunderstood the detail. She asked to start any proposed suspension after racing on the 22 July.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson stated Ms Fawcett’s record, which he said was not great.

Ms Fawcett was:

Warned on 9 March 2023.

Fined on 11 March 2023 – $250.

Suspended on 18 March 2023 – 5 days.

Suspended on 10 June 2023 – 5 days.

Fined on 11 June 2023 – $500.

Mr Davidson said the poor record requires an uplift in Penalty but stated Ms Fawcett is a very busy Rider who travels the entire length of the country to race.

REASONS FOR PENALTY:

The Penalty Guidelines provide a starting point of a 5+ day suspension for a breach at this level.

Ms Fawcett’s record is a concern and the Adjudicative Committee advised her to reread the new Whip Regulations and put them into practice.

An uplift of one day from the starting point was considered appropriate in this case and accordingly, a 6-day suspension was imposed. Ms Fawcett’s request for deferment was granted.

CONCLUSION:

Class A Jockey Ms Jasmine Fawcett’s Licence to ride in races is suspended from the conclusion of racing on the 22 July, up to and including racing on the 2 August 2023.
