Penalty: Jockey, Madan Singh is fined $250

Evidence:

Following the running of Race 6 Mr Singh admitted a charge that he raised his arm in an action above his shoulder height. The charge was issued under Rule 638(3)(f)(i) which requires: –

 … a rider must not use his or her whip using an action that raises the riders arm above shoulder height.

Details of the breach are as follows:

In that he used his whip above shoulder height on FLOWER OF WANAKA.

Stipendiary Stewards identified the incident through available film. Mr Singh is seen to strike his mount with his action clearly above shoulder height.

Mr Singh confirmed that he agreed with the Stewards’ contention.

Decision:

As Mr Singh admitted the breach it is deemed to be proved.

Submissions for Penalty:

Mr Oatham confirmed that Mr Singh has a clear record in respect of any  breach of this particular Whip Rule. He did comment that precedent breaches provided limited guidance as to penalty with some suggesting a starting point of a $250 fine.

Mr Singh did not offer comment.

Reasons for Penalty:

Film satisfactorily identified the Respondent striking his mount in an action which is a clear brief of the applicable Rule. Referenced to the Listing of Penalties, a fine of $250 is deemed appropriate.

Conclusion:

Mr Madan Singh is fined a sum of $250.
