FACTS

Mr Singh admitted a breach of Rule 638(3)(g)(i) in that he struck his mount “WHATSUP” six times prior to the 100m (5 is the limit).

Mr Singh said that he understood the Rule, charge and confirmed that he admitted the breach.

Film replays clearly showed the 6 strikes being applied prior to reaching the 100m.

DECISION

As the breach was admitted it was deemed proved.

PENALTY SUBMISSIONS

Mr Goodwin said that on 3 September 2022 Mr Singh was fined $900 following a whip breach in a Listed Race.  He referred to the Penalty Guide.

REASONS FOR PENALTY

Taking into account the record and Penalty Guideline, a fine of $250 was considered appropriate.

CONCLUSION

Mr Singh was fined $250.
