Mr Munro, Stipendiary Steward, alleged that horse 4 RUBY SEDDON broke in excess of 50 metres in the final 200 metres in Race 9.

Mr Munro demonstrated on the videos by using the marker pegs as a guide that some 60 or 70 metres from the winning post RUBY SEDDON broke and continued in a gallop past the finishing line.
Mr Williamson, the Driver of RUBY SEDDON, represented the connections of that horse, and did not contest the protest.
It was clear from the videos that RUBY SEDDON galloped at about the 65 metre mark and continued in a gallop across the finishing line. RUBY SEDDON has broken free of interference. Accordingly, RUBY SEDDON is in breach of r 870(3) and the relevant Breaking Horse Regulations.
RUBY SEDDON is disqualified pursuant to r 1003(2).
The protest is upheld. Amended placings are:

4th  2  EXPENSIVE CRUMPET
Stakes and dividends are to be paid accordingly.
