FACTS:
Jockey Nick Downs admitted a breach of Rule 638(3)(g)(i) in that he struck his mount 6 times prior to the 100 metre mark.
EVIDENCE:
The films of the incident were shown by Stipendiary Steward N Goodwin and counted by both parties. Class D Jckey N Downs agreed that the Rule was breached by one strike, and he wondered if dispensation could be granted as it was only one over.
It was pointed out to him that that could not happen, the Rules and the Penalty Guidelines make no allowances for that.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS ON PENALTY:
Jockey N Downs has had two breaches of the Rule – 20/4/23 and 27/5/23, resulting in a one day suspension and a $500 fine.
Stipendiary Steward N Goodwin asked for a fine as per the Guidelines, be imposed.
REASONS FOR PENALTY:
As per the Guidelines, it was determined that a fine was an appropriate penalty in this case.
