SUMMARY OF FACTS:
Mr Downs the Rider of KIPKEINO in Race 5 (CLC Pakuranga Hunt Cup) was charged with failing to make the declared weight (approx. 1kg over).
EVIDENCE:
Mr Jones said that normally a $100 fine would have been imposed under the Minor Infringement, however as the race was a prestigious jumping event with a stake of $50,000 the matter had been put to the Committee.
SUBMISSION FOR PENALTY:
Mr Jones said that Mr Downs had a clear record and submitted that a fine in the vicinity of $200 would be appropriate.
Mr Downs told the Trainer of KIPKEINO that he could be overweight and he thought that she would have told the Stewards. He said that he took on more than he could chew, as it was a lot harder to lose weight at this time.
REASON FOR PENALTY:
Giving due consideration to all matters in relation to penalty it was determined that a fine of $200 was appropriate.
CONCLUSIONS:
Mr Downs was fined $200.
