Background:
Following the running of Race 7, the ‘MacDougalls Maiden Highweight’ an Information was lodged alleging a breach of Rule 638(3)(g)(i). The Information read as follows:
‘in that she used her whip on Our Jet eight times prior to the 100 metres’.
Rule 638(3)(g)(i) provides .. (g) a Rider must not (i) except as provided for in (iii)(A) and (iii)(B) of this sub rule, strike a horse with a whip more than 5 times prior to to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);
The Respondent confirmed that she understood the pertinent Rule and admitted the breach.
Evidence:
Stewards, by way of film, identified the incident. Between the approximate 600 metre point and the 200 metre mark, the Respondent is seen to strike her mount on 5 occasions, with a further 3 strikes noted between this point and the 100 metres. The Respondent agreed with Steward interpretation/count. By way of explanation, she noted she had become confused as to her obligations under the Rule as it relates to Flat (Highweight) and Jumps races.
Decision:
As the charge was admitted, it was deemed proved.
Submissions as to Penalty:
Stewards advised the Respondent’s record. Her record does remain clear as it relates to any breach of this Rule within the last six months. Stewards recommended a penalty in line with the current Penalty Guide ie: a fine of $500 – 1st offence, 3 additional strikes. The Respondent did not offer comment in respect of Penalty.
Reasons for Penalty:
Film identifies the breach. The current Penalty Guide provides for a $500 fine for a breach of this Rule, 1st offence. Whilst the Adjudicative Committee acknowledges the explanation of the Respondent, it found no compelling reason to deviate from the Guide. Therefore, upon consideration, a fine of $500 was determined to be the appropriate penalty.
Conclusion:
Jockey Ms Ellie Callwood (Class D) is fined a sum of $500.
