Penalty: Jockey Chris Johnson was suspended for 5 National Riding Days

Evidence

Following the running of Race 1, Chris Johnson admitted a charge of Careless Riding which was filed pursuant to Rule 638(1)(d).

The Information alleged that as the Rider of REDDINGTON, Mr Johnston permitted his mount to shift inwards forcing DUCK DUCK GOOSE (B May) onto POPPIES BOY (L Callaway) who was checked passing the 900 metres.

Mr Johnston acknowledged he understood the Rule and confirmed his admission of the breach.

Rule 638(1)(d) provides

A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films Stipendiary Steward, Mr Mark Davidson, demonstrated the incident and the horses concerned.

Mr Davidson said that Mr Johnson’s horse was racing wide passing the 900 metre mark and has shifted inwards causing DUCK DUCK GOOSE, onto POPPIES BOY with Mr Callaway taking a hold of his horse who was checked.

Mr Johnson had no comment.

Decision

As the Respondent Mr Johnson admitted the breach, the Adjudicative Committee finds the breach proved.

Submission for Penalty

Stipendiary Steward Mr Davidson advised that Mr Johnson had an outstanding record with over 400 rides this last season with no breaches under this Rule. Mr Davidson said the breach was mid to low range and that a penalty reflecting that may be appropriate.

Mr Johnson had no submissions on penalty and confirmed that he did not seek deferment of penalty.

Reasons for Penalty

After considering the submissions the Adjudicative Committee determined the Respondent’s carelessness to be the mid to low range, which has a starting point of a six day national suspension.

The available films show that Mr Johnson has made a simple error of judgement in this instance and has moved inwards too quickly causing interference to those horses inside. After taking into account the Respondent’s excellent record under the Rule and his admittance of the breach, a one day discount is applied to the start point, accordingly Mr Johnson is suspended for 5 National Riding Days.

Conclusion 

Mr Johnson is suspended for 5 National Riding Days commencing after racing on the 9th October 2022 and concluding after racing on the 19th October 2022.
