Penalty: Junior Driver Daniel Anderson is fined $250

Mr Munro alleged that in Race 11, Mr Anderson (JACCKA EVAN) used his whip with more than a wrist flick in the run home.

Miss Haley demonstrated the incident on the videos. As the field made its way down the home straight, the Respondent, who was driving the trailing runner and had taken the passing lane run, used his whip with his whole arm on a number of occasions. It was not in a wrist flicking manner.

Mr Munro said that 2 strikes were of particular concern to the Stewards, hence they had charged Mr Anderson, rather than just issuing a warning.

Mr Anderson, who had had the assistance of Mr Barclay, said he had got carried away in the moment and accepted the Stewards’ analysis of the videos.

Decision

As Mr Anderson has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Munro produced the Respondent’s record which showed that Mr Anderson has had 354 life time drives; 80 this season and 109 the last. His record is clear under this Rule. Mr Munro submitted the breach was low level.

Mr Anderson said it was the first time he had been charged under the Whip Rule. He said he preferred a fine rather than a suspension.

Reasons for Penalty

The breach is at the lower end of the range. Mr Anderson has used his whip with more than a wrist flicking action, in breach of the Whip Rule and the Whip and Rein Regulations, in the home straight. The use is for a distance of approximately 50 metres. The Penalty Guide provides a starting point of a fine of $300 or a 2-day suspension for a first such breach.

A penalty just below starting point in the Penalty Guide is appropriate, when consideration is had to Mr Anderson’s excellent record, his admission of the breach, and his status as a Junior Driver.

Conclusion

Mr Anderson is fined the sum of $250.
