FACTS

Mr McNab admitted a breach of Rule 638(3)(g)(i) in that he struck his mount “MAUNA LOA” six times prior to the 100m (5 is the limit).

Mr McNab said that he understood the Rule, charge and advised the hearing that he admitted the breach.

Film replays confirmed that six strikes had been applied before reaching the 100m.

Mr McNab agreed with the number.

DECISION

The charge was admitted, accordingly it was found proved.

PENALTY SUBMISSIONS

Mr Goodwin said Mr McNab had a very good record with only one prior warning.

Mr Oatham advised the Adjudicative Committee that Mr McNab had had approximately 720 Race rides over the last 12 months and also said it was a very good record.

REASONS FOR PENALTY

Mr McNab’s mount “MAUNA LOA” went on to win the race, however after giving due regard to the excellent record over a period of time, a fine of $300 was considered to be a suitable penalty.

CONCLUSION

Mr McNab was fined $300.
