Penalty: Jockey Michael McNab is suspended for 5 National Riding Days

Evidence:

Following the running of Race 7, the NZB Insurance Pearl Series Race, Mr Dooley presented an Information charging Mr McNab, the Rider of “C’EST MOI” with careless riding, in breach of Rule 638(1)(d), approximately 200 metres from the finish.

Mr Jones demonstrated from the race films the actions of Mr McNab which amounted to careless riding.  Mr McNab, when seeking a run on “C’EST MOI” near the 200 metre mark, angled his mount inwards when not sufficiently clear of, and so as to make contact with, “BIT NOSY” (C Lammas), which was then forced inwards to crowd “FAIRY STEPS” (N Parmar) which had to be checked.  “C’EST MOI” went on to finish first, and “BIT NOSY” finished third.  The breach was in the low range.

Decision:

As Mr McNab admitted the breach, it was deemed proved.

Submissions for Penalty:

Mr McNab is a very busy Senior Rider, having had over 700 rides in the past 12 months, and had incurred 3 suspensions for a breach of this Rule over that period.  That could be seen as a good record, being less than one lapse in 200 rides.

Reasons for Penalty:

The starting point of 5 National Riding Days suspension is adopted, and it is not considered necessary to provide any uplift.

Mr McNab has committed riding engagements over the Canterbury Jockey Club meetings at Riccarton up to 12 November 2022 (10 days hence) and the Rules entitle him to a deferment of the commencement of the suspension until after racing on that day.

Conclusion:

Accordingly, Mr McNab’s Licence to ride is suspended for 5 National Riding Days to commence at the conclusion of racing on 12 November 2022 and to end at the conclusion of racing on 19 November 2022.
