FACTS:
Mr Kozzi Asano the Rider of “DISS IS DRAMATIC” admitted a breach of Rule 638(3)(g)(i) in that he used his whip excessively prior to the 100m (6 strikes).
Mr Asano said that he understood the Rule, charge and confirmed that he admitted the breach.
Film replays were shown with Mr Oatham identifying the 6 strikes prior to the 100m (5 being the limit).
Mr Asano said that he miscounted.
Ms Clapperton was of the opinion that the long straight may have contributed to the error.
DECISION:
The charge was admitted and was therefore found proved.
PENALTY SUBMISSIONS:
Mr Oatham produced Mr Asano’s record which showed two prior breaches of the Rule;
10.11.21 – Suspended for 7 days
05.03.22 – Fined $250
Mr Oatham referred to the Penalty Guide.
Mr Asano and Ms Clapperton did not comment.
REASONS FOR PENALTY:
The Penalty Guide starting point is for a fine of $500 for a third breach in six months.
Taking all matters into consideration it was deemed by the Adjudicative Committee that the starting point was a suitable penalty.
CONCLUSION:
Mr Asano was fined $500.
