Penalty: Rider Stephan Karnicnik is fined $150
Evidence:
Following the running of Race 7 (Grant Plumbing Wellington Steeplechase) an Information was lodged alleging the Respondent struck his mount in consecutive strides. Details are as follows:
‘in that he struck his mount Coconut in consecutive strides prior to jumping the last fence’Â
Mr Karnicnik confirmed to the Adjudicative Committee that he admitted the breach.
Rule 638(3)(h)(ii) provides that in a Jumping Race or trial a Rider must not:
‘ strike a horse with a whip in consecutive strides at any stage of the race‘
Using available film Stewards demonstrated that the Respondent struck his mount in consecutive strides prior to jumping the last fence. It was also noted there was an additional strike prior to the fence. Coconut finished third in the race earning a stake of $1,125.
Mr Karnicnik readily agreed with the film and count but was firm of the view that his actions were taken to protect the safety of himself and his mount. He contended that the horse was very tired but was too close to the fence to retire ie: was committed to jumping the fence. He added that if he did not act in the manner that he did the horse would have hit the fence.
Decision:
As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.
Submissions for Penalty:
Stewards presented the Respondent’s record which remains clear for this breach type. Penalty in line with the current Guidelines was recommended.
Reasons for Penalty:
Penalty Guidelines (effective 26th April 2022) provide for a warning for a 1st offence of this type. However, given the status of the race as a Prestige Jumping Race Respondents are not not afforded a warning. Starting point is a fine equal to 50% of the Jockey’s share of the stake earned by their mount – $56.25. In addition it is noted that a $150 fine is recommended as a starting point for a 2nd offence. Given the status of the race and circumstances surrounding the offence this level of fine was deemed appropriate.
Conclusion:
The Respondent Mr Stephan Karnicnik is fined $150.
