SUMMARY OF FACTS:

Class D Jockey Mr Karnicnik admitted a breach of Rule 638(3)(g)(i) in that he struck his mount “IZYMYDAAD” 8 times prior to the 100m (5 is the limit).

Mr Karnicnik said that he understood the Rule, charge and confirmed that he admitted the breach.

Mr Jones showed film replays and identified where Mr Karnicnik had struck his mount 8 times prior to the 100m.

Mr Karnicnik agreed with the number.

DECISION:

As the charge was admitted together with the film evidence, it was found proved.

PENALTY SUBMISSIONS:

Mr Jones said that the Respondent had a clear record with the Penalty Guide referred to, which had a starting point of a fine of $500.

Mr Karnicnik said that he would have difficulty with a $500 fine and requested that his licence be suspended.

REASONS FOR PENALTY:

The film evidence was very clear in showing Mr Karnicnik striking his mount no less than 8 times prior to the 100m.

The Penalty Guidelines, which came into effect on 26 April 2022, for Class D Jockeys, has a starting point of a $500 fine for 8 strikes prior to the 100m.

Mr Karnicnik’s request for a suspension was considered, however the Adjudicative Committee was of the opinion that the Guideline ($500) was the appropriate penalty to impose.

CONCLUSION:

Mr Karnicnik was fined $500.
