Penalty: Rider Lisa Allpress is suspended for 4 National Riding days

Evidence:

Following the running of Race 3 the Respondent admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d). Details are as follows:

“in that L Allpress (Bananarahma) allowed her mount to shift inwards when not sufficiently clear of Taser (K Hercock) which was checked near the 200 metre”

The Respondent acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1)(d) provides:

“A rider shall not ride in a manner the Adjudicative Committee considers to be careless”

Using available films, Stipendiary Stewards demonstrated the incident and identified the horses involved. At the 200 metre mark BANANARAHMA was positioned 2-3 horse widths from the fence behind FLOWER OF WANAKA (Ms F Lazet). At this point Mrs Allpress looks to  improve on the inside of FLOWER OF WANAKA when insufficiently clear of TASER who is positioned to her inside. TASER is then checked with Ms Hercock  forced to stop riding momentarily.

Mrs  Allpress outlined that when she initiated the move there was, in her view, sufficient room. She added that FLOWER OF WANAKA began to roll in contributing to the incident. She was unaware that TASER was so close but took evasive action as soon as Ms Hercock alerted her.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Senior Stipendiary Steward Mr Goodwin outlined Mrs Allpress’ riding record which indicates 2 previous breaches under the Careless Riding Rule within the last twelve months:

13/1/2022 4 days mid range

19/3/2022 5 days low range

This record is in the context of Mrs Allpress being one of New Zealand’s busiest Riders with 743 mounts for the season ending 31st July 2022 and 70 mounts for the season to date.

Stipendiary Stewards considered the level of carelessness to be low range. Mrs Allpress asked that given the circumstances, a suspension of 3 days be considered. She sought deferment to satisfy riding engagements up to and including New Plymouth on 17th September 2022.

Reasons for Penalty:

After considering evidence and submissions, the Adjudicative Committee determined the careless to be in the low range and accordingly adopted a 5 day suspension as a starting point. This is in line with the current NZTR Penalty Guide. The Adjudicative Committee is satisfied that the Respondent was insufficiently clear of TASER when looking to improve on the inside of FLOWER OF WANAKA. The starting point of 5 days was reduced by 1 day to reflect a commendable riding record.

Conclusion:

The Respondent’s request for deferment is granted with her licence to ride in races suspended for 4 National Riding Days from completion of racing on 17th September 2022 up to and including racing on 23rd September 2022.
