Evidence:

Following the running of Race 5, the “Lisa Latta Racing Stables 1600”, Mr Goodwin presented an Information charging Mr Asano, the Rider of “BOURBON FALLS” with careless riding at the 200 metre mark, in breach of Rule 638(1)(d).

It was alleged that Mr Asano allowed his mount to shift inwards when passing the 200 metre point, when not sufficiently clear of “PRINCESS ELLY” (ridden by Ms L Sutherland), causing it to be checked.

Mr Goodwin illustrated the breach of the Rule by reference to the race films, that Mr Asano’s mount was racing well into the home straight, “one off” the fence immediately behind Ms Sutherland’s mount “PRINCESS ELLY”.  Both horses were in contention.  Initially there was insufficient room to provide a run for “BOURBON FALLS”.

Mr Asano elected to attempt to find room to overtake  “PRINCESS ELLY” on the inside, but was insufficiently clear and a severe check was caused to that horse.  It was made worse by an outward movement by “FREYJA’S GODDESS” (Ms C Butler), but the damage caused by Mr Asano’s inward movement had already been done.  “PRINCESS ELLY” was severely checked.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Goodwin advised that Mr Asano has had 651 rides over the past 12 months, being a busy Rider.  His record for careless riding breaches is not good with suspensions from 9-11 days being imposed, although some were for Black Type Races at Premier Meetings.  This present breach was assessed as mid-range.

Mr Asano said he had commitments up until the Te Rapa Meeting on 14 April 2024.

Reasons for Penalty:

The Adjudicative Committee applies the Guide starting point (7 days), but as the event was made to appear worse because of the later movement of Ms Butler’s mount, the Adjudicative Committee does not consider an aggravating adjustment is necessary.

Conclusion:

Accordingly, Mr Asano’s Licence to ride is suspended for 7 National Riding Days, from the conclusion of racing on 14 April 2024 and to finish at the conclusion of racing on 25 April 2024.
