Evidence:

Following the running of Race 2, Apprentice Rider Ms F Barrett admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that F Barrett directed her mount TIME AFTER TIME outwards when not clear, making heavy contact with NIGHTOWL, which became unbalanced near the 600m.

The Respondent acknowledged she understood the Rule and confirmed her admission of the breach. Apprentice Mentor Ms Kim Clapperton was present to assist.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using available race footage, Stipendiary Steward Ms K Jillings showed that NIGHTOWL and TIME AFTER TIME were racing at the back of the field. Ms Barrett was riding on the fence, positioned to the inside of NIGHTOWL, ridden by Mr Riddell. She found herself in a difficult position with no opportunity to improve. As Ms Barrett attempted to ease out, Mr Riddell maintained his line, which resulted in significant contact with NIGHTOWL, causing that horse to be turned sideways. Mr Goodwin observed that there is a fine line between competitive and careless riding, and, in this case, Ms Barrett’s actions crossed that line.

In response, Ms Barrett acknowledged she had tried to move out, but was prevented by Mr Riddell, admitted fault, and apologised for her actions.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

When making submissions on penalty, Mr Goodwin noted Ms Barrett’s clear record and suggested that she would learn from this incident. He assessed the carelessness as being in the mid to low range, and pointed out that Ms Barrett had had 31 rides to date. Mr Sharrock, Ms Barrett’s employer, advised that she had riding commitments through until next Saturday at Otaki.

Reasons for Penalty:

Ms Barrett is an inexperienced Apprentice. On this occasion, she attempted to make room for her horse, but was unable to because Mr Riddell, an experienced Rider, gave her no space. The Adjudicative Committee emphasised the importance of safety, especially since NIGHTOWL suffered significant interference, noting that although it did not impact the final placings, safety must remain the priority.

The Adjudicative Committee adopted a six-day suspension as the starting point, following the NZTR Penalty Guide as of February 2025. Taking into account Ms Barrett’s admission and inexperience, a one-day reduction was applied. After considering all factors, a five-day suspension was imposed.

Conclusion:

Ms Barrett’s request for a deferment is granted and her Licence to ride in races is suspended for a period of 5 days, commencing after racing on Saturday September 6th and concluding after racing on Saturday September 13th.
