EVIDENCE:
Following the running of Race 4, Mr Goodwin presented an Information charging Mr Lawson-Carroll with a breach of Whip Rule 638(3)(f)(ii) in that he used his whip with arm raised above shoulder height in the final straight on his mount THRILLING.
Mr Lawson-Carroll admitted the charge, and had with him Senior Rider Mr C Dell for support.
The race films illustrated Mr Lawson-Carroll using his whip several times in the home straight, and on one occasion, it could be seen to go above shoulder height.
Mr Lawson-Carroll said he is quite small and he sometimes has to exaggerate the movement of his whip. Mr Dell said in total, Mr Lawson-Carroll had only used the whip 3 times, none forcefully, and only 1 of those was above shoulder height.
DECISION:
As the charge was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Mr Goodwin advised that Mr Lawson-Carroll has had 540 rides in the last year. He has a previous charge from Trentham in December, where he was fined $300 for using the whip in the same manner on 3 occasions.
Mr Lawson-Carroll advanced no penalty submissions.
REASONS FOR PENALTY:
The Adjudicative Committee regarded this as a very low level breach. There was only one strike above the shoulder, the horse was not excessively hit and no unfair advantage was gained.
CONCLUSION:
Accordingly, Mr Lawson-Carroll was fined $250.
