Wanganui JC 14 March 2026 – R4 – Adam Scott

EVIDENCE:

Ms Selvakumaran presented an Information charging Mr Scott with a breach of Rule 537(a) in that, being the Trainer of LUCKY PENNY to race in Race 4, the “FULL CIRCLE APPEARANCE MEDICINE MDN 1340”, failed to declare the name of a Rider for that horse by the time and date specified by the NZTR.

Mr Scott admitted the breach of the Rule and advised that he did not wish to be present at any hearing.

The facts were that Mr Scott was required to declare a Rider by Wednesday 11 March 2026, but failed to do so until 11.25am on Friday 13 March 2026.  This was his 3rd breach of Rule 537(a) within 120 days.

Mr Scott’s explanation was that he had delayed declaring a Rider for this horse as he hoped that its connections would, or might, scratch the horse.  The Rider declared, Ms C Lindsay, was always available to be secured as the Rider.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Normally, breaches of Rule 537(a) are dealt with under the Minor Offence procedure, with fines of $50 and $100 for first and second breaches.  But where, as here, there is a third breach and, the Stipendiary Steward considers that minor offence penalties fixed in the Fourth Appendix ($50 and $100 for 2 breaches, but none in fact detailed for the 3rd or more breaches) are insufficient, and a more substantial fine is warranted (Rule 926(2)), it may or is to proceed by way of a normal Information.

REASONS FOR PENALTY:

Although the NZTR Penalty Guide Starting Points where an Information is filed does not refer to breaches (3rd or more) of Rule 537(a), a proper interpretation and application of the Rules in this particular context, requires that to impose fines for up to 2 breaches, would be insufficient and inappropriate.

CONCLUSION:

Accordingly, a fine of $150 is imposed on Mr Scott.
