Penalty: Driver Mark Hurrell is suspended for 3 days

Mr Munro alleged that in Race 8, Mr Hurrell (NEK DELIGHT) shifted ground inwards when not sufficiently clear passing the 2000 metres, checking a trailing runner (RIGHTAZZ) Mr B Williamson.

Mr Munro demonstrated on the videos that Mr Hurrell was 3 wide near the 2000 metres and came across when not clear. Mr Williamson was racing one off. As Mr Hurrell came across, he contacted a front leg of RIGHTAZZ with the wheel of his cart. RIGHTAZZ galloped, losing all chance and was retired from the race. A couple of other horses were also briefly hampered as a consequence. NEK DELIGHT eventually progressed to the lead and ultimately finished 5th.

Mr Hurrell said he agreed with Mr Munro that he had come across a stride too soon. He was not fully across and had tried to squeeze in front of Mr Williamson. He was going hard to get round him.

Mr Munro added that when galloping, RIGHTAZZ had contacted the wheel of Mr Orange (ON THE WING) and the tyre had deflated.

Decision

As Mr Hurrell has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Munro described the breach as high level. He produced the Respondent’s record, which is clear under this Rule. Mr Hurrell has had 2472 lifetime drives, 20 this season and 257 the last. Mr Munro submitted a penalty in accordance with the Penalty Guide was appropriate, with regard being had to record and admission of the breach. Mr Hurrell asked whether the Adjudicative Committee would consider a fine.

Reasons for Penalty

The breach is high end. RIGHTAZZ has lost all chance, and a number of other horses have had their chances affected as well. In these circumstances, a suspension is the appropriate penalty; not a fine. Mr Hurrell has admitted the breach at the first opportunity and has a clear record under the Careless Driving Rule. Balancing the aggravating and mitigating factors, results in a 3-day suspension.

Conclusion

Mr Hurrell’s Licence to drive is suspended from the end of racing today, 9 February, up to and including 21 February 2025 (3 days).
