FACTS:

Apprentice Jockey J Chung admitted a charge brought under Rule 638(3)(e) in that he used his whip in an unnecessary manner.

The films of the incident were shown and commented on by Stipendiary Steward N Goodwin. It could be clearly seen SMOKIN MO being struck with the whip on the horse’s shoulder.

Jockey J Chung stated that SMOKIN MO could be difficult to ride and on two occasions during the race, he ducked inwards.

Trainer M Breslin confirmed this and Racing Mentor K Clapperton said the horse could be difficult to ride. However, she believed that striking the horse on the shoulder, while not acceptable, was brought on by frustration.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

In keeping with the Penalty Guidelines, Stipendiary Steward N Goodwin proposed that a fine was an appropriate penalty in this case.

REASONS FOR PENALTY:

In coming to its decision to fine Apprentice Jockey J Chung for the breach, consideration was given to his admittance of the breach, his obvious remorse in his actions and the fact that this was the first time he has been charged under this Rule.

CONCLUSION:

A fine of $200 was imposed.
