Ms Mahoney, after having sought a Ruling, proceeded to scratch her remaining runners contrary to the Ruling given.
DECISION:
Ms Mahoney admitted the breach, therefore the charge was deemed proved.
SUBMISSION FOR PENALTY:
Stipendiary Steward Mr Dooley advised that Ms Mahoney had a clear record in regard to the Rule. He submitted there had been 2 similar recent cases, one resulting in a fine of $350 and given that this breach involved 3 horses, the Stewards would seek a fine of between $400-$500.
REASON FOR PENALTY:
Ms Mahoney scratched the horses after the declared scratching time, and there had not been a change to the track conditions.
In this instance, the Adjudicative Committee determined that the appropriate penalty was a $400 fine.
CONCLUSION:
Trainer Ms Mahoney is fined $400.
