SUMMARY OF FACTS:

Following the running of Race 6 the “Dunstan Horsefeeds Balmerino Stakes”  Mr Oatham presented an Information charging Mr Bosson with a breach of Rule 638(3)(g)(i) in that he struck his mount ROBUSTO with his whip more than 5 times prior to the 100 metre mark.

SUBMISSIONS:

Mr Oatham referred to the race film which illustrated that when ROBUSTO was mounting a challenge in the home straight Mr Bosson struck it with his whip 6 times prior to the 100 metre mark.  The strikes were placed some time apart.

Mr Bosson said that he has misjudged his actions and was only just over the degree required by the Rule.  He had not been riding a lot recently and the revised Guide was only issued in September 2021.

REASON FOR DECISION:

As Mr Bosson admitted the breach it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Oatham advised that Mr Bosson has had a clear record under the Rule, the breach was at a low level and sought only a penalty of $250 in line with the Penalty Guidelines.

REASON FOR PENALTY:

Given Mr Oatham’s submission on penalty, Mr Bosson is fined $250.
