SUMMARY OF FACTS:
Following the running of Race 7, the Sky City Hilton Waikato Cup Day 11/12 2100, Mr Jones presented an Information alleging that Ms Spratt committed a breach of Rule 638(3)(g)(i) in that she struck her mount, PEECEE PUSSYCAT more than 5 times prior to the 100 metre mark.
SUBMISSIONS:
Mr Jones demonstrated from the race film that Ms Spratt stuck her mount with the whip 6 times in the straight prior to the 100 metre mark.
Ms Spratt contended that her actions involved only one more strike than is permitted, she acknowledged that this was a breach of the Rule and accepted that she was required to face an appropriate penalty.
REASON FOR DECISION:
As Ms Spratt admitted the breach, it was deemed proved.
SUBMISSION FOR PENALTY:
Ms Spratt has had one previous breach of the Rule, in August 2021.
REASON FOR PENALTY:
Accordingly, in line with the Penalty Guide she is fined $500 (as her share of the stake earned was very much less and minimal).
CONCLUSIONS:
Ms Spratt is fined $500.
