FACTS
Following Race 5, Mr Craig Grylls the Rider of “SEDAKA” admitted a breach of Rule 638(3)(g)(i). The breach being that Mr Grylls struck his mount with the whip 6 times prior to the 100m (5 is the limit). “SEDAKA” finished second-place, earning prize money of $25,900.
Mr Grylls said that he understood the Rule, charge and confirmed that he admitted the breach.
Mr Oatham showed film replays and identified where “SEDAKA” had been struck 6 times with the whip.
Mr Grylls said that as he was wide on the track he had difficulty in seeing the 100m peg and just misjudged it.
DECISION
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS
The record showed that Mr Grylls had 3 prior breaches of the Rule:
10 September 2022 – fined $250
15 October 2022 – suspended 5 Days + $400 Fine
31 December 2022 – fined $500
Mr Oatham referred to the Penalty Guide which stated a 2-day suspension and a fine of $500 for a fourth breach. Mr Oatham said that as it was a Group II event a Rider could be fined 50% share of his share of the prize money, if more than $500.
He also said that a suspension could be greater than 2 days.
Mr Grylls said that the Guidelines are what they are.
REASONS FOR PENALTY
The Adjudicative Committee in reaching its decision took into account the record, admission of the breach and the status of the Race.
CONCLUSION
Mr Grylls’ Jockey’s Licence was suspended from end of racing on 8 January 2023 up to and including racing on 13 January 2023 (3 days) and a $600 fine imposed.
