Permission was given for the charge to be preferred by RIB Management.

This Information was heard at the Tauranga Racecourse.

Ms Abel with the assistance of Ms Gerard admitted a breach of Rule 638(3)(g)(i).  The breach being that when riding “TRIGON LAD” in Race 10, she struck the horse 8 times with the whip prior to the 100m.  “TRIGON LAD” went on to win the Race.

Ms Abel said that she understood the Rule, charge and confirmed that she admitted the breach.

Mr Jones showed film replays and identified where the 8 strikes were applied.

Ms Abel and Ms Gerard agreed.  Ms Abel said that she became a little excited.

DECISION

As the charge was admitted it was deemed to be proved.

PENALTY SUBMISSIONS

Mr Jones said that Ms Abel had had 25 rides in the 12 months and had a clear record.

He said that although she hit her horse 8 times prior to the 100m (5 is the limit) she only struck it one more time in the final 100m.  He said that the starting point for 8 strikes is a fine of $500.

Ms Abel did not comment.

REASONS FOR PENALTY

Taken into account when determining penalty was the clear record, admission of breach, inexperience and that Ms Abel only struck her mount one more time over the concluding stages.

CONCLUSION

The Adjudicative Committee was of the opinion that on this occasion, there was no reason to depart from the Penalty Guide starting point.

Ms Abel was fined $500.
