Background

Mr Mulcay alleged that Dr Chin (SAFRAKOVA) used his whip in more than a wrist flicking motion in the run home in Race 3.

Mr Mulcay demonstrated on the videos that the Respondent when making a run to the outside of the track used his whip in more than a wrist flicking manner. He said the Respondent was initially compliant but had become more vigorous in his action.

Dr Chin explained that it was a close finish, his horse was responding, and he was vigorously shaking the reins. He had the whip in the same hand as the rein, with the whip parallel to the rein. He accepted it was more than a wrist flicking motion and said he would think about whether he would carry a whip in future.

Decision as to breach

As Dr Chin has admitted the breach, it is found to be proved.

Submissions as to penalty

Mr Mulcay stated that the breach was mid-range. Dr Chin had a clear record under this Rule. He submitted a $500 fine was appropriate.

Dr Chin did not disagree.

Reason for Penalty

Dr Chin has admitted using his whip with more than a wrist flicking motion over the last 100 metres of Race 3. It has continued for some distance and is a medium-level breach. The starting point in the Penalty Guidelines for a first breach is a fine of $500. There is no reason to increase this starting point.

Conclusion

Dr Chin is fined the sum of $500.
