Penalty: Driver Luk Chin is suspended for 3 days

Mr Mulcay alleged that Dr Chin (SAFRAKOVA) used his whip in more than a wrist flicking motion in the run home in Race 6.

Mr Mulcay demonstrated on the videos that the Respondent when making a run to the outside of the track, used his whip in more than a wrist flicking manner. He said the forearm was raised and the elbow engaged a number of times. Dr Chin accepted it was more than a wrist flicking motion and said he had hit the horse a little too hard.

Decision

As Dr Chin has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Mulcay stated that the breach was low-range. The strikes were not continuous, and Dr Chin had reverted to a compliant action. He submitted as this was a 2nd breach within 6 months, a 3-day suspension was appropriate. Dr Chin asked that the suspension start immediately.

Reasons for Penalty

Dr Chin has admitted using his whip with more than a wrist flicking motion in the home straight in Race 6. It was not continuous and is a low-level breach. The starting point in the Penalty Guide for a second breach within a 6-month period, is a 3-day suspension. There is no reason to increase this starting point.

Conclusion

Dr Chin is suspended from the end of tonight’s meeting, up to and including 18 May 2023.
