FACTS:

Information A18308 alleged that 2nd placed horse “WISHING STAR” broke in excess of 150m during the race.

The provisional placings were:

1st        CYCLONE LEBRON

2nd      WISHING STAR

3rd       THE LAWMAN

4th      MONT BLANC

5th       PRESIDENTS TOPSHOT

SUBMISSIONS FOR DECISION:

Mr Dooley showed film replays and identified that with 1800m to travel, “WISHING STAR” commenced to gallop and continued to gallop for 180-200m.

Mr Abernethy said that he had discussed the matter with the Trainers of the horse and that they agreed with the distance the horse had galloped.

Under questioning from the Adjudicative Committee, Mr Abernethy said that the connections were happy for him to represent them at the hearing and that they did not contest the protest.

REASONS FOR DECISION:

As “WISHING STAR” had galloped in excess of the permissible 150m, it was disqualified by the Adjudicative Committee.

Placings now read:

1st       CYCLONE LEBRON

2nd      THE LAWMAN

3rd       MONT BLANC

4th       PRESIDENTS TOPSHOT

Dividends and prizemoney to be paid on the amended placings.
