Penalty: Driver Sailesh Abernethy is fined $200
FACTS:
Mr Sailesh Abernethy admitted a breach of Rule 869(2) in that he used his whip with more than a wrist flicking motion when driving “CLYMENUS”.
Mr Abernethy said that he understood the Rule, Charge and confirmed that he admitted the breach.
Mr Williams showed film replays and said that early in the run home Mr Abernethy breached the Rule 5 or 6 times.
Mr Abernethy agreed.
DECISION:
As the charge was admitted it was found proved.
PENALTY SUBMISSIONS:
Mr Mulcay said that Mr Abernethy had had one warning only for a whip breach. He placed the breach in the low-end and referred to the Penalty Guide.
Mr Abernethy did not comment.
REASONS FOR PENALTY:
There was not any reason to depart from the starting point of $200.
CONCLUSION:
Mr S Abernethy was fined $200.
