FACTS

Following Race 9, Mr Paynter the Driver of ‘NGAURUHOE’, admitted a breach of Rule 869(2) & the Whip & Rein Regulations.  The breach being that in the run home, he used his whip free of the rein on several occasions.

Mr Paynter advised that he understood the Rule, charge and confirmed his admission of the breach.

Film replays were shown with Mr Renault identifying that there were four strikes with the whip when free of the rein.

Mr Paynter agreed that it was four times.

DECISION

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS

Mr Dooley said that Mr Paynter had a clear record and placed the breach at the low-end.

Mr Paynter did not comment.

REASONS FOR PENALTY

The Penalty Guide starting point for a low-end breach is a fine of $300.

As there was not any reason to depart from the starting point figure, it was deemed appropriate.

CONCLUSION

Mr R Paynter was fined $300.
