FACTS
Mr K Asano the Rider of ‘LAUDING’, was charged with allowing his mount to shift in when not clear of ‘TREATY OF PARIS’, which was forced inwards forcing ‘ANNETARZ’ in, resulting in ‘BRONTES GOLD’ having to be checked near the 100m.
Mr Asano said that he understood the Rule, charge and confirmed that he admitted the breach.
Mr Stewart showed film replays and identified all horses involved in the incident.
He said that Mr Asano shifted in about 1 ½ horse widths when not clear which caused the resultant interference.
Mr Asano said that his horse was hanging from the top of the straight and that he tried to straighten it and also wanted to win the race.
DECISION
As the charge was admitted, it was deemed proved by the Adjudicative Committee.
PENALTY SUBMISSIONS
Mr Jones said that Mr Asano had had 588 rides in the previous 12 months with four careless riding charges within that period.
Mr Jones said that the record was on the verge of being an aggravating feature; he placed the carelessness in the mid-range.
Mr Asano said that he would like any suspension to start after 18 March.
REASONS FOR PENALTY
The Adjudicative Committee placed the careless riding displayed by Mr Asano in the mid-range category. The Penalty Guide starting point for mid-range has a starting point of 7-days suspension. This was increased to 8-days as Mr Asano’s mount ‘LAUDING’ went on to win the race. A discount of one day was given for the admitted breach.
CONCLUSION
Mr K Asano had his Jockey’s Licence suspended from end of racing on 18 March through to 1 April 2023 inclusive (7 National Days).
