FACTS
Mr J Bayliss admitted a breach of Rue 638(3)(g)(ii) in that he used his whip in two consecutive strides near the 50m when riding “FLORENCENIGHTNGALE”.
Mr Bayliss said that he understood the Whip Rules, charge and confirmed that he admitted the breach.
Mr Jones showed film replays and identified where the breach occurred.
DECISION
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS
Mr Jones said that Mr Bayliss had a clear record under the section of the Rule and referred to the Penalty Guide.
Mr Bayliss said that it was an error and that he is trying hard to comply with the Whip Rules.
REASONS FOR PENALTY
There was no reason to depart from the Penalty Guide starting point of $150 fine.
CONCLUSION
