FACTS

Following Race 8 Mr Bayliss admitted a breach of Rule 638(3)(g)(ii).  The breach being that he used his whip in two consecutive strides on two occasions on his mount “LANGKAWI” near the 50m.

Mr Bayliss understood the Rule, charge and confirmed to the Adjudicative Committee that he admitted the breach.

Mr Jones showed film replays and identified Mr Bayliss striking his mount on two consecutive strides, gave one stride respite, then again used the whip on two consecutive strides.

Mr Bayliss agreed with the Stipendiary Steward’s interpretation.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

Mr Jones alluded to Mr Bayliss’ record with this being the second breach on the day and said that the starting point for a second breach of the Rule is a fine of $300.  However as Mr Bayliss had used his whip twice in succession, he invited the Committee to consider an increase on the starting point.

Mr Bayliss said that he was obviously having trouble adapting to the Rules after riding in Singapore.  He added that what had happened today was a big learning curve.

 REASONS FOR PENALTY

Mr Bayliss’ record was taken into account, as was the relatively serious breach of the Rule.  The starting point of $300 was considered to be inadequate under all of the circumstances, with an uplift of $200 deemed appropriate.

 CONCLUSION

Mr Jake Bayliss was fined $500.
