Evidence
Following the running of Race 6, the Respondent Class A Rider Ms J Fawcett admitted a charge alleging excessive whip use prior to the 100 metres.
The Information alleged that Ms Fawcett struck her mount (DIAMOND JAK) 8 times prior to the 100 metres.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or
Using the available race films, Senior Stipendiary Steward Mr B Jones identified DIAMOND JAK (J Fawcett) who was racing wide out on the track. He pointed out that from the straight entrance to the 100-metre mark, Ms Fawcett struck her mount 8 times.
Ms Fawcett said that she agreed with the number of strikes. By way of explanation, she said that she misjudged the number of strikes.
Decision
As Ms Fawcett admitted the breach, the Adjudicative Committee finds the breach proved.
Submissions for Penalty
Mr Jones advised that Ms Fawcett has a clear record with regards to whip breaches, within the 6 month reset period. He added that from 640 rides this current season, which is in its last week of racing, this is Ms Fawcett’s first whip breach.
Mr Jones submitted that the Penalty Guide provides to a $500 fine and recommended that a fine in this vicinity would be an appropriate penalty.
Ms Fawcett had nothing further to add.
Reasons for Penalty
The Penalty Guide starting point for a breach of this nature, is a fine of $500.
After reviewing the films, it was noted that Ms Fawcett’s mount finished the race off strongly in second place. Having had 640 rides this season and noting that Ms Fawcett is a very busy National Rider, it is a credit to her that she has been able to maintain a clear record with regards to whip breaches for the entire season. Accordingly, other than acknowledging her unblemished record, there are no reasons to deviate from the $500 fine starting point.
Conclusion
Class A Rider Ms Fawcett is fined $500.
