Background:

Stewards filed an Information in relation to Race 2, the ‘Bunnings New Plymouth Maiden 1200’. The Information was lodged pursuant to Rule 534(1). Details are as follows:

‘Failed to scratch ‘Grisham’ by the deadline on race morning’ 

Rule 534(1) provides:

534(1) At any time from the Withdrawal Deadline to the scratching deadline (as specified for the relevant Race Meeting in accordance with Rule 510(d)(v) or as amended by NZTR from time to time) on the relevant Race day, a person intending to scratch a horse from a Race (after it has been accepted or is deemed to have been accepted) shall give notice to that effect to NZTR and where such notice for scratching a horse refers to a Race Meeting but does not specify a particular Race at that Race Meeting, such notice shall be deemed to apply to all Races for which the horse has been accepted or deemed to have been accepted at that Race Meeting.

The Respondent confirmed that he understood the Rule and admitted the breach.

Evidence:

Mr Gillovic had two horses in Race 2 namely ‘GRISHAM’ and ‘JUST GO BOOM’. Stewards confirmed that the Respondent had communicated with NZTR on 3rd December 2025, with ‘JUST GO BOOM’ scratched at 1.05 pm. It was the Respondent’s intent to also scratch ‘GRISHAM’, however this was not communicated. The horse was ultimately scratched on race day at 7.55 am, after the required deadline. Mr Gillovic agreed with the timeline of events as outlined by Stewards and by way explanation, conveyed an oversight on his part.

Decision:

As Mr Gillovic admitted the breach, it was deemed proved.

Submissions for Penalty:

The Adjudicative Committee was referred to the current Penalty Guide, where the starting point for this breach, is a fine of $200 in circumstance that no horse was denied a start as a result.

Reasons for Penalty

After consideration, the Adjudicative Committee found no reason to deviate from this.

Conclusion:

Mr Gillovic is fined a sum of $200.
