Background:

Following the running of Race 3, an Information was lodged alleging a breach of Rule 638(3)(g)(i). Details of the breach are as follows:

‘Struck her mount MEGLIO DI FALCREST with the whip six times prior to the 100 metre mark with a further five strikes inside the 100 metres’.

The Respondent acknowledged that she understood the Rule and admitted the breach. This was endorsed by Ms Clapperton.

Rule 638(3)(g)(i) provides that in a Flat Race a rider must not:

‘strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)‘ where it shall not be a contravention of this rule if

‘a Rider strikes a horse six times prior to the 100 metre mark, provided that the Rider does not strike the horse more than four times after the 100 metre mark’

Evidence:

Stewards provided film evidence which demonstrated Ms Sutherland struck her mount on six occasions prior to the 100 metre mark and a further five occasions inside the 100 metre mark.

Ms Sutherland agreed with the count and had nothing further to add.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Stewards advised that Ms Sutherland has had one breach of this Rule within the last six  months – namely 6 May 2023. The Adjudicative Committee were referred to the current NZTR Penalty Guide.

Ms Sutherland did not provide comment in respect of penalty.

Reasons for Penalty:

The Penalty Guide starting point for second breach involving one additional strike is a fine of $250. Upon consideration the Adjudicative Committee determined this to be an appropriate penalty.

Conclusion:

Apprentice Jockey, Ms L Sutherland is fined $250.
