Evidence

Following the running of Race 1, the Respondent Ms L Sutherland admitted a charge alleging excessive whip use prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);

Using the available race films, Mr Oatham demonstrated that Ms Sutherland struck her mount 7 times from the straight entrance to the 100-metre mark, with two of those strikes being consecutive. She went on to finish 2nd in the race, beaten by 1/2 length.

Ms Sutherland agreed with the number of strikes as counted by the Stewards.

Decision

As Ms Sutherland admitted the breach the Adjudicative Committee finds the breach proved.

Submissions For Penalty

Mr Oatham produced Ms Sutherland’s record which showed three previous breaches in the last 6 months:

Stewards submitted a penalty commensurate with the NZTR Penalty Guide for excessive whip use. For the 2 consecutive strikes Ms Sutherland was issued a warning.

Ms Clapperton submitted that Ms Sutherland had a good record considering she is a busy Rider, and said her whip use was not aggressive. In case of suspension, Ms Sutherland advised of riding commitments through until October 23rd at Trentham.

After considering the film evidence of being 2 strikes over the permitted 5, and the submissions, the Adjudicative Committee determined a 6-day suspension to be appropriate.

Ms Sutherland’s request for a deferment is granted.

Conclusion

Ms Sutherland’s licence to ride in races is suspended for 6 days from close of racing on Saturday October 23rd until close of racing on November 1st, 2022.
