SUMMARY OF FACTS:
Following the running of Race 3 the Respondent Mr S O’Malley admitted a charge of Careless Riding which was filed pursuant to Rule 638(1)(d).
The Information alleged that Mr O’Malley “CHAJABA” allowed his mount to shift in crowding and checking REINE D’AMOUR passing the 225m.
EVIDENCE:
Mr Davidson outlined the incident using the available films. Near the 225m Mr O’Malley was racing 2-wide, he struck his mount with the whip with his horse shifting in and checking REINE D’AMOUR.
Mr O’Malley did not comment when invited to do so.
REASON FOR DECISION:
As Mr O’Malley admitted the breach the Adjudicative Committee found the breach proved.
SUBMISSION FOR PENALTY:
Mr Goodwin said that Mr O’Malley had a good record with only two breaches in the last twelve months. He placed the carelessness below mid-range.
Mr O’Malley asked that any suspension imposed commence after racing on 11 December.
REASON FOR PENALTY:
After considering all submissions and the film evidence, the Adjudicator placed the carelessness between low and mid-range. In line with the Penalty Guide a starting point of 6-Riding Days Suspension was adopted.
Giving due consideration to Mr O’Malley’s record and the admitted breach a discount of one day was deemed appropriate.
CONCLUSIONS:
Mr O’Malley’s Jockey’s Licence was suspended for 5-Riding Days from the end of racing on 11 December through to the close of racing on 19 December 2021.
