SUMMARY OF FACTS:

The Information alleged a breach of Rule 638 (3) (g) (i) in that S McKay (BRUCIE) used his whip excessively in the home straight.

At the outset of the hearing, Mr McKay confirmed he understood the Rule and admitted the breach.

Mr Goodwin used the videos to show Mr McKay strike his mount 6 times prior to the 100m. This is one over the Guidelines.

SUBMISSION FOR PENALTY:

Mr Goodwin said Mr McKay had a clear record in regard to the Whip Rule over the preceding 6 month period. Mr McKay confirmed this.

REASON FOR PENALTY:

The Committee had regard to the revised Penalty Guidelines. The starting point for a first offence whip breach is the greater of $250 or 50% of the Jockey’s share of the stake. The Committee estimated Mr McKay earned less than $250 for his share of the second place stake money.

There were no aggravating factors requiring an uplift from the starting point.

CONCLUSIONS:

Accordingly  Mr McKay is fined the sum of $250.
